The Notary Guy has an in-house Notary Public who can assist with advising on the most appropriate marriage regime, as well as draft, execute and register the antenuptial contract with the Deeds Office.
An antenuptial contract sets out and regulates the terms and conditions of a marriage between spouses. Concluding an antenuptial contract prior to the date of the marriage prevents the union from automatically being one in community of property.
Concluding an antenuptial contract allows prospective spouses to determine how their assets and gains are to be divided when the marriage is terminated. There are two alternatives to getting married in community of property:
Out of community of property, without accrual: the spouses retain what is theirs before the date of marriage, and also retain their assets and gains made after the date of the marriage.
Out of community of property, with accrual: the spouses retain what is theirs before the date of marriage, and the distribution of the growth in their respective estates is regulated by the antenuptial contract. The spouse with the smaller accrual has a claim for 50% of the difference between the growth of the two estates (or to any other percentage as agreed by the spouses in the antenuptial contract).
